To the EGLE FOIA Coordinator:
Pursuant to the Michigan Freedom of Information Act, MCL 15.231 et seq., I request copies of the following public records concerning the properties at 10221, 10455 and 10635 Textile Road, Ypsilanti Township, Washtenaw County — tax parcels K-11-24-300-010, K-11-24-400-006 and K-11-24-400-007 — and the proposed University of Michigan / Los Alamos National Laboratory research computing center.
Records may be indexed under Location ID 81000971 or 81000985, or under the Regents of the University of Michigan, Apex Companies LLC, or SmithGroup, Inc.
Time period: January 1, 2023 through the date this request is processed.
Part A — Wetlands and inland waters
Any wetland determination, delineation, or assessment for the properties, whether prepared by or submitted to the Department.
Any application, pre-application submittal, or permit issued under Part 303 (Wetlands Protection), Part 301 (Inland Lakes and Streams), or Part 315 (Dam Safety) relating to the properties.
All correspondence concerning wetland jurisdiction, boundaries, or proposed impacts at the properties.
Part B — Stormwater and erosion control
Any application for or coverage under the NPDES construction stormwater permit for the properties, including the notice of coverage and any Storm Water Pollution Prevention Plan.
Any soil erosion and sedimentation control plan, permit, or correspondence relating to the properties under Part 91.
Any records concerning post-construction stormwater management, including proposed discharge points to the Huron River or its tributaries.
Part C — Discharges and water supply
Any records concerning proposed process water discharge from the facility, including cooling tower blowdown, and any correspondence with the Ypsilanti Community Utilities Authority regarding industrial pretreatment.
Any application, registration, or correspondence under Part 327 (Great Lakes Preservation) or the Water Withdrawal Assessment Tool concerning water withdrawal at the properties.
Any records concerning the water supply proposed to serve the facility, including correspondence with YCUA or the Great Lakes Water Authority.
Part D — Contamination and due care
The complete files for Baseline Environmental Assessment submittals 81000971-BEA-1 and 81000985-BEA-1, including all attachments and appendices, and any Department correspondence, review notes, or determinations concerning them.
Any due care plan, due care evaluation, or documentation of response activity submitted under Section 20107a of Part 201 for either property.
Any records concerning the Department's knowledge of prior contamination, prior releases, or remedial activity at or adjacent to the properties, including any relationship to the former General Motors Willow Run facility.
Any records concerning EPA identifier MID980825558 or any CERCLA or Superfund record associated with the Textile Road site.
Part E — Air
Any application, permit to install, or pre-application correspondence concerning emergency or standby generators at the properties, including proposed generator count, ratings, fuel type and storage, and any modelling submitted under the air use permit program.
Part F — Correspondence
All correspondence between the Department and the University of Michigan, Apex Companies LLC, SmithGroup, Inc., the Michigan Economic Development Corporation, DTE, YCUA, or Ypsilanti Township concerning the properties or the proposed facility.

Fees: I request a waiver or reduction under MCL 15.234(1). These records concern the environmental conditions and permitting of a proposed $1.25 billion facility on a site the Department has already recorded as a Part 201 facility, adjacent to the Huron River and within a residential township. Disclosure is likely to contribute significantly to public understanding of the operations of a public body, and the records will be published freely. If fees are assessed, please provide a detailed itemized estimate and contact me before incurring any cost above $50. I am willing to narrow this request and would rather discuss scope than receive a denial.
If any portion is denied, please cite the specific exemption for each withheld record and release all reasonably segregable non-exempt portions under MCL 15.244.
